• You are not prohibited from using our services under applicable law

3. Account Registration and Security

To use Herdish, you must create an account by providing accurate and complete information. You may register using your email address or through third-party authentication services like Google.

• Notifying us immediately of any unauthorized access or security breach
• Ensuring your account information remains accurate and up-to-date

4. User Conduct and Prohibited Activities

5. Matching and AI Algorithm

5.1 How Matching Works

Herdish uses AI-powered algorithms to analyze your questionnaire responses and match you with compatible users. Our matching system considers various factors to determine compatibility scores.

5.2 No Guarantees

While we strive to provide accurate and meaningful matches, we do not guarantee:

• That you will find compatible matches
• The accuracy of compatibility scores
• The success of any relationships formed through the platform
• The behavior or intentions of other users

5.3 Referral System

Our referral system allows you to unlock matches by referring new users. Referral codes must be used legitimately, and any abuse of the referral system may result in account suspension.

6. User Content and Intellectual Property

6.1 Your Content

You retain ownership of any content you submit to Herdish, including profile information, questionnaire responses, and messages. By submitting content, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, and process your content to provide our services.

6.2 Our Intellectual Property

All content, features, and functionality of Herdish, including but not limited to text, graphics, logos, software, and algorithms, are owned by Herdish and protected by copyright, trademark, and other intellectual property laws.

6.3 Restrictions

You may not:

• Copy, modify, or distribute our content without permission
• Reverse engineer or attempt to extract our source code
• Remove or alter any copyright or proprietary notices
• Use our trademarks without written permission

7. Privacy and Data Protection

Your privacy is important to us. Our collection, use, and protection of your personal information is governed by our Privacy Policy, which is incorporated into these Terms of Service by reference. By using Herdish, you consent to our data practices as described in the Privacy Policy.

8. Safety and Interactions

8.1 User Responsibility

You are solely responsible for your interactions with other users. We encourage you to:

• Meet in public places for initial meetings
• Inform friends or family of your plans
• Trust your instincts and report suspicious behavior

8.2 Background Checks

Herdish does not conduct criminal background checks on users. We are not responsible for the conduct of any user on or off the platform.

If you experience or witness inappropriate behavior, harassment, or violations of these terms, please report it to us immediately at support@herdish.com.

9. Payment and Subscriptions

Currently, Herdish is free to use with a referral-based system to unlock matches. We reserve the right to introduce paid features or subscriptions in the future. Any such changes will be communicated to users in advance.

10. Disclaimers and Limitations of Liability

10.1 Service Provided As-Is

Herdish is provided on an "as is" and "as available" basis without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

10.2 No Liability

To the maximum extent permitted by law, Herdish and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

• Loss of profits, data, or goodwill
• Service interruptions or errors
• Conduct of other users
• Unauthorized access to your account or data
• Any damages arising from your use of the platform

10.3 Limitation of Damages

Our total liability to you for any claims arising from your use of Herdish shall not exceed the amount you paid to us in the twelve months preceding the claim, or $100, whichever is greater.

11. Indemnification

You agree to indemnify, defend, and hold harmless Herdish and its affiliates, officers, directors, employees, and agents from any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorney fees) arising from:

• Your use of the platform
• Your violation of these terms
• Your violation of any rights of another person or entity
• Your content or conduct on the platform

12. Dispute Resolution and Arbitration

12.1 Informal Resolution

If you have a dispute with Herdish, please contact us first at support@herdish.com to attempt to resolve the issue informally.

12.2 Binding Arbitration

Any dispute that cannot be resolved informally shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. You waive your right to participate in class action lawsuits or class-wide arbitration.

These terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles.

13. Termination

You may terminate your account at any time by contacting us or using the account deletion feature. Upon termination:

• Your access to the platform will be revoked
• Your profile and data will be deleted within 30 days

• These terms will continue to apply to any past use of the platform
